Your super can own property. The rules are unlike anything else.

A self-managed super fund lets members control how their retirement savings are invested — including buying physical property. Done right, it's a powerful, legitimate strategy, especially for business owners buying their own premises in a low-tax structure. Done wrong, it draws ATO enforcement, severe penalties, and forced sales.

§ 02 What an SMSF is

You're the investor — and the trustee.

A fund of up to 6 members who are also the trustees. Members control the investments — that's what sets it apart from an industry or retail fund. It's regulated by the ATO, and each trustee is personally responsible for compliance. No insurer, no backstop.

These costs are fixed regardless of fund size — which is why a small fund can lose more to compliance than it gains in tax.

§ 03 The Sole Purpose Test

One question governs every decision.

Ask of every decision

"Is this for members' retirement — or a current benefit to someone today?"

Breaches the test: a member living in the fund's residential property; renting it to family; collectibles hung at home. None is banned by a single rule — they all produce a current personal benefit.

The penalty is severe

A breach can make the fund non-complying — stripping its concessional status and triggering 45% tax on the fund's entire asset base, plus civil and, in the worst cases, criminal penalties.

§ 04 What it can buy

Residential is strict. Commercial is the opportunity.

The big one: a business owner can have the SMSF buy their premises, pay market rent in (deductible to the business), and grow the asset in a structure taxed at just 15%.

§ 05 Buying from related parties

Generally banned — with one key exception.

An SMSF generally cannot acquire assets from a related party — members, relatives, entities they control — even at market value.

Business real property — used wholly & exclusively in a business. This is how an owner moves their premises into the SMSF.

A personal residential investment property cannot be transferred in this way.

A transfer is still subject to stamp duty, is a CGT event for the seller, and must be at market value.

"Business real property" is fact-sensitive

The ATO definition turns on the property's actual use and nature. Get qualified SMSF legal and accounting advice before any transfer — don't treat the exception as straightforward.

§ 06 Borrowing — the LRBA

If the fund borrows, it must use this exact structure.

Limited recourse: if the fund defaults, the lender can take only the property in the bare trust — not the fund's other assets. While the loan runs, you can do like-for-like repairs but not improvements that change the asset's character.

Get the structure right first time

The bare trust and loan documents must be set up correctly by a specialist SMSF solicitor before settlement. Errors in the structure can't easily be fixed afterwards.

The fund must hold a cash buffer to service the loan — auditors expect it. The loan's in the bare trustee's name; members have no personal liability, but a default loses the property.

§ 08 Tax — accumulation phase

Versus a 37–45% personal rate, that gap is the whole argument. But the fund must be big enough: $100k paying $4k compliance to save $1.5k tax is going backwards. Break-even is often cited around a $300k–$400k minimum balance.

§ 09 Tax — pension phase

The payoff: zero.

Tax on rental income and capital gains, for assets supporting a pension in retirement phase.

Sell a long-grown property once the fund's in pension phase and the entire gain is tax-free. Held personally at 45% with the 50% discount, that gain is taxed ~22.5% — on a $400k gain, a ~$90k difference.

The transfer balance cap

There's a legislated cap on how much you can hold in the tax-free retirement phase — around $1.9M (2023–24, indexed). Above it, further earnings are taxed at accumulation rates. Verify the current cap at ato.gov.au.

§ 10 The 5% in-house asset rule

A trap that creeps up on commercial-premises funds.

No more than 5% of the fund's total assets (by market value) can be "in-house assets" — broadly, things leased to or invested in related parties.

If the SMSF leases premises to your related business and that property is most of the fund, you can breach the limit as it appreciates. Breach it and you must dispose of enough to get back under 5% within 12 months — and trustees often only discover it at the annual audit, when the clock's already running.

This isn't a reason to avoid the strategy; it's a reason to engage an accredited SMSF accountant and an LRBA solicitor, and keep ongoing compliance support.
